When someone creates a trust, the trust goes into effect immediately. You transfer whatever assets you chose into the trust, and you select a trusted person who will serve as trustee upon your death or incapacity. Trust agreements allow you to retain control of your assets while you are living, have a trusted person manage your assets when you are incapable of doing so, and they allow you to maintain your privacy. Unlike a will which becomes public during the probate process, a trust remains private. Trusts need not be probated which means any property placed in them does not go through the probate process.
